Estate Planning

Adams Law is particularly adept at formulating estate planning solutions based on our clients’ particular and individualized needs. We draft comprehensive probate-avoidance revocable trusts, as well as specialized asset protection, special needs, and wealth management irrevocable trusts. We assist our clients in the trust funding process, and we are equipped to handle trust and probate administration.

Estate planning is the process by which an individual or family arranges the transfer of assets in anticipation of death. An estate plan aims to preserve the maximum amount of wealth possible for the intended beneficiaries and flexibility for the individual prior to death. A major concern for drafters of estate plans is federal and state tax law.

Lack of proper planning can cause costly expenses, court supervision of your estate, unnecessary taxes, delays, and an increased probability that your last wishes will not be abided. Our professionals engage the proper estate planning process to produce your preferred results.

We are experienced in drafting Wills, Trusts, Advanced Health Care Directives, Health Care Advocacy Designations, Durable General Powers of Attorney, Special Limited Powers of Attorney, Special Needs Trusts, Intentionally Defective Grantor Trusts, Temporary Parental Authority Designations and much more.

We fund your trusts! If you have a new trust, or a trust drafted elsewhere which was never properly funded, we help you fund your trust before the end of our engagement.

If you have questions, we have answers. It is never too early to start putting together a proper estate plan. All of our estate planning services are completed to accommodate each client’s individualized business, tax, and wealth management needs.

  • Who do intend will receive your assets upon your death?
  • Will you give your assets to your beneficiaries in a lump-sum, or will you prefer that it be distributed over time?
  • Who do you want to manage your assets and personal affairs if you become disabled or pass away?
  • To whom do you want to give the power to make healthcare decisions for you if you become disabled?
  • What types of medical care do you want if you are incapacitated or terminally ill?
  • Who will be the legal guardian of your minor children in the event something happens to you?
  • How can you minimize taxes, expenses, court supervision, problems, or delays for your family if you become disabled or die?

Corporate Transparency Act

In the ever-evolving landscape of corporate governance, staying informed about the latest regulations is paramount. The Corporate Transparency Act (CTA) has emerged as a significant development, bringing forth crucial changes in the realm of corporate compliance.

The Corporate Transparency Act, signed into law in 2020, is a subsection of the Anti-Money Laundering Act; this Act is our federal government’s attempt at enhanced corporate transparency, to try to prevent illicit financial activities.

Who Needs To Comply?

Anyone with any business entity type (e.g., LLC, INC, CO, LTD, LC, PLC, LP, LLP, LLLP, PLLC, PC, etc.). If you filed a document to create a business with any bureaucratic department of your State government, then you need to comply with the CTA obligations before the year is up.

Reporting Requirements and Compliance.

Adams Law understands how to navigate your business through the specific reporting requirements mandated by the CTA, to ensure compliance. From identifying beneficial ownership, to submitting accurate and timely reports, Adams Law can help your business meet its obligations under the Act.

Non-compliance with the CTA can result in severe, statutory penalties, and because there will not exist any predictable regulatory enforcement precedent for quite some time, Adams Law provides strategic guidance on maintaining compliance to simply avoid the unknown pitfalls, and instead safeguard your business interests.

For personalized legal advice tailored to your unique CTA compliance, contact Adams Law today.
